HB 96 (Ohio, 136th GA): budget provision ending new data center sales-tax exemption agreements (line-item vetoed)

vetoed

The FY2026-27 budget as passed barred the Ohio Tax Credit Authority from entering new computer data center sales and use tax exemption agreements. Gov. DeWine line-item vetoed that item on July 1, 2025, keeping the exemption (ORC 122.175), which cost about $1.6 billion in 2025 per the Department of Taxation. The veto message calls the exemption "important as Ohio competes ... for technology jobs".
