pending

On October 6, 2026 Duke Energy Carolinas and Duke Energy Progress filed with the North Carolina Utilities Commission an Agreement and Stipulation of Settlement on Large Load Tariff, signed with the Public Staff, Amazon Data Services, Andale LLC, the Carolina Industrial Group for Fair Utility Rates II and III, the U.S. Department of Defense and other federal agencies, Google and Microsoft. The proposed tariff applies to service agreements signed on or after June 1, 2026 by customers of 50 MW or more at an 80% or higher load factor, or of 150 MW or more at any load factor: dedicated facilities paid up front as a contribution in aid of construction, a letter of credit for transmission network upgrades, minimum contract terms of 10 to 15 years, minimum billing at 75% of contract demand, 24- to 48-month exit notice with liquidated damages, and interruptibility during the load ramp. It would be effective for service on and after January 1, 2027. The Commission had not ruled as of October 15, 2026; no order approving the settlement exists yet.
